Supreme People's Court
The Constitution states that the people's courts of the PRC are the judicial organs of the state. The PRC establishes a Supreme People's Court, local people's courts at all levels, and special people's courts such as military courts.
The Supreme People's Court is the highest judicial organ. It is responsible for hearing cases of all types, making judicial interpretation, and supervising the administration of justice by the local people's courts at all levels and the special people's courts. It also supervises, within the limits of its authority prescribed by the law, the judicial administration of all courts across the country.
The term of office of the president of the Supreme People's Court is the same as that of the NPC. The president serves no more than two consecutive terms.
The Supreme People's Court is responsible to and reports on its work to the NPC and its Standing Committee. In addition to hearing cases, the Supreme People's Court also manages and coordinates the enforcement of all courts, for which it has set up an enforcement bureau to take charge.
最高人民法院
《中華人民共和國憲法》規(guī)定,中華人民共和國人民法院是國家的審判機關。中華人民共和國設立最高人民法院、地方各級人民法院和軍事法院等專門人民法院。
最高人民法院是中華人民共和國最高審判機關,負責審理各類案件,制定司法解釋,監(jiān)督地方各級人民法院和專門人民法院的審判工作,并依照法律確定的職責范圍,管理全國法院的司法行政工作。最高人民法院院長每屆任期同全國人民代表大會每屆任期相同,連續(xù)任職不得超過兩屆。
最高人民法院對全國人民代表大會及其常務委員會負責并報告工作。最高人民法院除負責審判案件外,還負責統(tǒng)一管理、統(tǒng)一協(xié)調全國法院的執(zhí)行工作,設立執(zhí)行局負責這項工作的管理、監(jiān)督、協(xié)調。
