Environmental Impact Assessment
Environmental impact assessment refers to such practices as analyzing, forecasting and evaluating the unintended impacts on the environment of various plans and construction projects, and proposing measures to prevent or relieve negative impacts and conduct follow-up monitoring.
In November 1998, the State Council issued regulations on environmental protection of construction projects, specifying the procedures and legal liabilities related to environmental impact assessment.
In October 2002, the Standing Committee of the National People's Congress adopted the Law on Environmental Impact Assessment, which elevated the legal status of environmental impact assessment. The law was revised on two occasions, once in July 2016 and again in December 2018.
In August 2009, the State Council adopted regulations on the environmental impact assessment of various construction and development plans.
環(huán)境影響評價
環(huán)境影響評價,是指對規(guī)劃和建設(shè)項目實施后可能造成的環(huán)境影響進行分析、預(yù)測和評估,提出預(yù)防或者減輕不良環(huán)境影響的對策和措施,進行跟蹤監(jiān)測的方法與制度。
1998年11月,國務(wù)院通過《建設(shè)項目環(huán)境保護管理條例》,全面規(guī)范了環(huán)境影響評價的內(nèi)容、程序和法律責(zé)任。2002年10月,全國人大常委會通過《中華人民共和國環(huán)境影響評價法》,進一步強化了環(huán)境影響評價的法律地位。2009年8月,國務(wù)院通過《規(guī)劃環(huán)境影響評價條例》,環(huán)境影響評價制度形成“一法兩條例”。2016年7月和2018年12月,全國人大常委會兩次修正《環(huán)境影響評價法》,環(huán)境影響評價“放管服”改革不斷推進。
